These Terms and Conditions (“Terms”) apply to purchases made from RE:SOUND, including new, pre-owned and ex-display products.
By placing an order with RE:SOUND,, you agree to these Terms.
Nothing in these Terms excludes or limits any mandatory rights available to consumers under applicable Cyprus or European Union consumer protection law.
1. ABOUT RE:SOUND
RE is based in Cyprus and supplies new and pre-owned audio products and related goods to customers in Cyprus and, for eligible products, internationally.
Throughout these Terms, “RE:SOUND”, “we”, “us” and “our” refer to RE:SOUND.
2. PRODUCTS
RE:SOUND, offers new, pre-owned and, where indicated, ex-display products.
We make reasonable efforts to ensure that product descriptions, specifications, photographs, condition reports, included accessories and prices are accurate.
Product images are provided to represent the item as accurately as reasonably possible. Colours and appearance may vary slightly depending on photography, lighting and display settings.
Availability is subject to stock.
3. PRE-OWNED PRODUCTS
Products identified as “Pre-Owned”, “Used”, “Second-Hand”, “Ex-Demo” or similar may have been previously owned, used or displayed.
Pre-owned products may therefore show reasonable signs of previous use, including cosmetic marks, scratches or wear.
Where reasonably identifiable, significant cosmetic imperfections, missing accessories or other relevant conditions will be disclosed in the product description or otherwise communicated before purchase.
Normal signs of use or specific imperfections that were clearly disclosed before purchase are taken into account when assessing the condition and conformity of a pre-owned product, subject to applicable consumer law.
Because many pre-owned products are individual items, availability may be limited to one unit.
4. PRICES
Prices are displayed in the currency indicated on the RE:SOUND, website or sales documentation.
Where applicable, VAT will be included or identified in accordance with applicable law.
For international orders, additional customs duties, import VAT, taxes, customs-clearance charges, brokerage fees or other charges may apply depending on the destination.
Unless expressly stated otherwise, such charges imposed by the destination country, customs authority or carrier are the responsibility of the customer.
5. ORDERS
By placing an order, the customer offers to purchase the selected product under these Terms.
Orders remain subject to product availability, payment verification and acceptance by RE:SOUND,.
RE:SOUND, may decline or cancel an order where, for example, a product is unavailable, payment cannot be verified, delivery is not possible, an obvious pricing or listing error has occurred, or the transaction cannot lawfully be completed.
If RE cancels an order after receiving payment, the amount due to the customer will be refunded.
6. PAYMENT METHODS
Available payment methods may depend on the product and destination.
Bank Transfer
Bank Transfer is available worldwide for pre-owned products that are eligible for international sale.
Orders paid by bank transfer may be processed and dispatched only after cleared funds have been received by RE:SOUND,.
The customer is responsible for ensuring that the full amount due is received by RE:SOUND,. Bank, intermediary-bank, currency-conversion or transfer charges imposed on the customer are the customer’s responsibility unless otherwise agreed.
Pick Up
Pick Up is available in Cyprus only.
Where Pick Up is selected, RE:SOUND, will provide the customer with the relevant collection arrangements.
Customers should wait for confirmation that their order is ready before attempting collection.
Pay on Delivery
Pay on Delivery is available in Cyprus only.
Pay on Delivery is not available for international orders. Only Credit Card payment is available as such.
Additional payment methods may be offered where indicated during checkout or agreed with RE:SOUND,.
7. SHIPPING WITHIN CYPRUS
RE delivers eligible products within Cyprus using the available delivery methods indicated at checkout or otherwise agreed with the customer.
Any stated delivery date or period is an estimate unless a specific delivery date has expressly been agreed.
Customers are responsible for providing complete and accurate delivery and contact information.
8. INTERNATIONAL SHIPPING
International shipping is available only for products that RE:SOUND, identifies as eligible for international sale.
Not every product offered by RE:SOUND, is available for international delivery.
For eligible pre-owned products, Bank Transfer is available worldwide.
International delivery availability and shipping costs depend on the product, destination, size, weight, carrier availability and any applicable shipping or legal restrictions.
The customer is responsible for ensuring that a product may legally be imported into the destination country.
International customers may be responsible for customs duties, import VAT, taxes, customs-clearance fees, brokerage charges and other local charges imposed by authorities or carriers.
9. DELIVERY AND TRANSPORT DAMAGE
RE takes reasonable care when preparing and packaging products for delivery.
For consumer sales where RE:SOUND, arranges delivery, risk in the goods passes in accordance with applicable consumer law.
Customers should inspect their products as soon as reasonably possible following delivery.
If a parcel or product appears to have been damaged during transportation, the customer should contact RE:SOUND, promptly and provide photographs of the packaging and product where possible.
Nothing in this section limits the customer’s mandatory statutory rights.
10. 14-DAY RIGHT OF WITHDRAWAL
Where the statutory right of withdrawal applies to a distance or online consumer purchase, the consumer generally has 14 days from receipt of the goods to withdraw from the contract without giving a reason.
The customer must inform RE:SOUND, of the decision to withdraw within the applicable withdrawal period.
After notifying RE:SOUND,, the goods must be returned within the period required by applicable law.
The customer may inspect and handle the product only to the extent reasonably necessary to establish its nature, characteristics and functioning, comparable to the examination that would normally be permitted in a physical shop.
The customer may be responsible for diminished value resulting from handling beyond what is reasonably necessary for this purpose.
Unless RE:SOUND, agrees otherwise or applicable law requires otherwise, the customer is responsible for the direct cost of returning goods when exercising a change-of-mind withdrawal.
Where the statutory withdrawal right applies, RE:SOUND, will provide the reimbursement required by applicable law, including any applicable standard outbound delivery cost.
Where legally permitted, RE:SOUND, may withhold reimbursement until the returned goods have been received or the customer supplies evidence that the goods have been sent back.
Certain products or transactions may be excluded from the right of withdrawal where an exemption under applicable law applies.
11. RETURNS
Customers wishing to return a product should contact RE:SOUND, before sending the product back.
Customers may be asked to provide:

their order number;
-
details of the product;
-
the reason for the return; and
-
photographs or video where a product is claimed to be damaged, defective or incorrectly supplied.
Returned products should be securely packaged and, where reasonably possible, returned with the accessories and documentation originally supplied.
This return procedure is intended to allow RE:SOUND, to process returns efficiently and does not restrict any mandatory consumer rights.
12. EUROPEAN LEGAL GUARANTEE — NEW PRODUCTS
Consumers purchasing new goods from RE:SOUND, benefit from the statutory legal guarantee of conformity provided under applicable Cyprus and European Union consumer law.
New products are covered by the applicable minimum two-year legal guarantee from delivery, subject to the conditions established by law.
If a product does not conform to the sales contract, the consumer may be entitled to statutory remedies, which can include repair or replacement and, where the relevant legal requirements are satisfied, an appropriate price reduction or termination of the contract and refund.
These statutory rights apply independently of any additional manufacturer or commercial warranty.
13. LEGAL GUARANTEE — PRE-OWNED PRODUCTS
Consumers purchasing pre-owned products from RE:SOUND, also benefit from applicable statutory conformity rights.
Where permitted by applicable law and validly agreed with the customer, the legal guarantee period applicable to a pre-owned product may be reduced to one year from delivery.
Where a shorter period has not been validly agreed, the guarantee period required by applicable law will apply.
The legal guarantee relates to a lack of conformity for which RE:SOUND,is responsible under applicable law.
A pre-owned product is not expected to have the same cosmetic condition as an unused product. Its age, condition, price and any characteristics or imperfections specifically disclosed to the customer before purchase may be taken into account when determining conformity, to the extent permitted by law.
14. NORMAL WEAR, MISUSE AND DAMAGE
Subject to mandatory consumer rights, a guarantee does not ordinarily cover problems resulting solely from:
-
normal wear and tear;
-
cosmetic imperfections disclosed before purchase;
-
accidental damage occurring after delivery;
-
misuse, abuse or neglect;
-
improper handling or storage;
-
improper installation not performed or arranged by RE:SOUND,;
-
use contrary to the manufacturer’s instructions;
-
unauthorised repairs or modifications;
-
incompatible equipment or accessories;
-
liquid or moisture damage occurring after delivery;
-
electrical damage caused by external circumstances; or
-
other damage occurring after delivery that is unrelated to a lack of conformity for which RE:SOUND, is legally responsible.
Nothing in this section excludes rights relating to a defect or lack of conformity for which RE:SOUND, is responsible under applicable law.
15. MANUFACTURER WARRANTIES
Certain products may also include a manufacturer’s warranty or another commercial warranty.
Any such warranty is additional to the consumer’s statutory legal rights.
A manufacturer’s warranty does not replace or reduce the statutory legal guarantee provided by RE:SOUND, where RE:SOUND, is the seller.
The duration, conditions and geographic coverage of a manufacturer’s warranty are determined by the manufacturer unless RE:SOUND, expressly provides an additional commercial warranty of its own.
16. WARRANTY CLAIMS
Customers who believe that a product is defective or does not conform to the sales contract should contact RE:SOUND, and provide:
-
their order number or proof of purchase;
-
identification of the product;
-
a description of the issue; and
-
photographs or video where reasonably useful for identifying the problem.
RE:SOUND, may request reasonable additional information necessary to assess the claim.
Where a valid statutory claim exists, RE:SOUND, will provide the remedy required under applicable law.
Products should not be returned without first contacting RE:SOUND, for return instructions.
17. INTERNATIONAL WARRANTY CLAIMS
Customers outside Cyprus should contact RE:SOUND, before returning a product.
Where RE:SOUND, is legally responsible for a lack of conformity, applicable mandatory consumer rights will be respected.
A manufacturer’s international warranty, where available, is subject to the manufacturer’s own conditions and geographic coverage.
The international sale of a product by RE:SOUND, does not by itself mean that the product carries a worldwide manufacturer’s warranty.
18. CUSTOMER RESPONSIBILITIES
Customers are responsible for:
-
providing accurate billing, delivery and contact information;
-
ensuring payment is made correctly;
-
checking product compatibility where relevant;
-
following manufacturer operating and safety instructions;
-
obtaining any import permissions required in the destination country; and
-
paying applicable international import charges where these are the customer’s responsibility.
19. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
Subject to mandatory consumer protection law, RE:SOUND, will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was entered into.
Nothing in these Terms is intended to limit the statutory remedies available to consumers for goods that do not conform to the sales contract.
20. INTELLECTUAL PROPERTY
The RE:SOUND, name, branding, logos, website content, graphics, photographs and other materials owned by RE:SOUND, are protected by applicable intellectual-property laws.
RE:SOUND, is a trademark and brand of RE:SOUND,.
No RE:SOUND, trademark, logo, photograph or proprietary material may be reproduced, distributed or used for commercial purposes without prior authorisation from RE:SOUND,, except where such use is permitted by law.
Third-party trademarks, product names and manufacturer logos remain the property of their respective owners.
21. PRIVACY
Personal information supplied to RE :SOUND,will be processed in accordance with applicable data-protection legislation, including the General Data Protection Regulation (GDPR) where applicable, and the RE:SOUND, Privacy Policy.
Customers should review the Privacy Policy for further information regarding how personal information is collected, used, stored and protected.
22. FORCE MAJEURE
RE will not be responsible for a failure or delay in performing contractual obligations where that failure or delay results from circumstances beyond our reasonable control, subject to the customer’s mandatory statutory rights.
Such circumstances may include serious transport disruption, natural disasters, governmental restrictions, customs disruption, telecommunications failures or other exceptional events outside the reasonable control of RE:SOUND,.
23. GOVERNING LAW
These Terms are governed by the laws of the Republic of Cyprus, subject to any mandatory consumer protections that apply to the customer.
For consumers residing in another EU Member State, nothing in these Terms deprives the consumer of mandatory protections provided by the law applicable to them under European Union rules.
Any dispute will be handled by the competent courts in accordance with applicable jurisdiction and consumer-protection rules.
24. CHANGES TO THESE TERMS
RE:SOUND, may update these Terms from time to time to reflect changes to our services, business practices or applicable law.
The Terms applicable to an order will generally be those in effect when the order is placed, subject to any mandatory legal requirements.
